Malema, who leads the Economic Freedom Fighters (EFF), was found guilty last year on multiple charges, including unlawful possession of a firearm and ammunition, as well as reckless endangerment.
The case stems from an incident at an EFF rally in 2018 where Malema was filmed discharging what appeared to be a rifle during a public gathering, sparking widespread legal and political debate at the time.
Details of the Sentence
Delivering judgment, on Thursday, April 16, 2026, the court imposed an effective five-year prison term as the primary sentence.
Additional counts attracted lesser penalties, including sentences of up to two years’ imprisonment or the option of a fine of 20,000 South African rand, or six months’ imprisonment. These sentences are to run concurrently.
The court further declared Malema unfit to possess a firearm.
Appeal Underway Malema’s legal team has indicated its intention to appeal the ruling, a move that could delay the implementation of the sentence pending the outcome of higher court proceedings.
The EFF leader has consistently maintained his stance on the matter throughout the trial, while his supporters have previously described the case as politically motivated—an assertion not upheld in court.
Political Implications
The sentencing of one of South Africa’s most prominent opposition figures is expected to have significant political implications, particularly for the EFF, which has built a strong support base around Malema’s leadership.
It remains unclear how the appeal process will unfold or whether Malema will begin serving his sentence in the immediate term.
Authorities in South Africa have yet to issue further details regarding the timeline for enforcement of the sentence.
